Client’s 2005 conviction for recording the police vacated

A judge in the Woburn District Court vacated my client’s 2005 conviction for recording a police officer who had pulled him over. The First Circuit ruled in 2020 that the application of the Massachusetts wiretap law to criminalize the secret recording of police on the job was unconstitutional. The First Circuit joins seven other circuits that have struck down these types of statutes.
