Leaving the Scene of an Accident

Drivers who leave the scene of an accident where there has been property damage or injury to another person without stopping to exchange insurance information have committed a crime that can result in jail time and license loss. Recently, attorney Keren Goldenberg successfully represented a client accused of leaving the scene of an accident involving property damage at a Clerk-Magistrate Hearing. She convinced the Clerk not to issue a criminal complaint against her client providing that her client completed 20 hours of community service, provided proof that his insurance provider paid the other driver’s claim, and paid a $20 fine. Because her client did what was required of him, the application for the criminal complaint was dismissed and he was never formally charged. Because he was never charged there is no entry on his criminal record.
